Tohfa Shofa® is a trademark of Colour Taxi. This website is operated by Colour Taxi.
Throughout this website, the terms “we”, “us” and “our” refer to Colour Taxi, operating under the brand Tohfa Shofa.
By accessing this website, browsing our products, placing an order, submitting information, or using any of our services, you agree to be bound by these Terms of Service, together with our Privacy Policy, Shipping & Returns Policy, and any other policies or terms referenced on the website.
Please read these Terms carefully before using the website or placing an order. If you do not agree with these Terms, you should not access or use the website or purchase our products.
ONLINE STORE TERMS
By using this website or placing an order, you confirm that you are legally capable of entering into a binding transaction under applicable law.
You may not use our website, products, services, content, or systems for any unlawful, fraudulent, misleading, abusive, or unauthorised purpose.
You must not introduce viruses, malicious software, harmful code, automated attacks, or any technology intended to damage, disrupt, interfere with, scrape, access, or compromise the website, our systems, or the information of other users.
We reserve the right to restrict, suspend, or terminate access to the website where we reasonably believe these Terms have been violated.
GENERAL CONDITIONS
We reserve the right to refuse, restrict, hold, or cancel any order or service where reasonably necessary, including in cases involving suspected fraud, misuse, payment failure, abusive conduct, unlawful activity, pricing errors, suspicious transactions, repeated refusal of deliveries, unauthorised resale, or violation of these Terms.
We may modify, suspend, discontinue, or restrict any part of the website, product range, feature, service, or offering at any time.
You may not reproduce, duplicate, copy, sell, resell, distribute, publish, exploit, reverse-engineer, or commercially use any part of the website, our products, designs, artwork, photographs, videos, graphics, branding, text, or other content without our prior written permission.
The headings contained in these Terms are for convenience only and do not limit or otherwise affect the interpretation of these Terms.
PRODUCT INFORMATION
We take reasonable care to provide accurate product descriptions, dimensions, materials, photographs, colours, specifications, pricing, availability, and other information on the website.
However, product appearance may vary slightly due to screen settings, lighting, photography, printing processes, production techniques, handmade processes, natural materials, wood grain, texture, finishing, or other characteristics inherent to the product.
Minor differences in colour, grain, texture, finish, placement, print output, or other handmade or material-related characteristics are not considered defects.
Product images are intended to represent the product as accurately as reasonably possible, but they should not be interpreted as a guarantee of exact colour or appearance across every device or production batch.
Customers are responsible for carefully reviewing all product descriptions, dimensions, materials, customisation details, compatibility requirements, and other information before placing an order.
MADE-TO-ORDER PRODUCTS
Our products may be made, prepared, printed, assembled, finished, or customised after an order is placed.
Once an order has been confirmed and processing or production has begun, the order is considered final and cannot ordinarily be cancelled, refunded, or exchanged except where required by applicable law or where a valid claim exists under our Shipping & Returns Policy.
Changes requested after an order has entered production may not be possible.
Where we agree to accommodate a requested change, additional charges or revised timelines may apply.
CUSTOMISED AND PERSONALISED PRODUCTS
Customers are responsible for ensuring that all information submitted for customisation is complete and accurate.
This includes names, spellings, addresses, locations, dates, text, images, logos, artwork, colours, specifications, reference material, and any other information provided for the creation of a customised product.
We are not responsible for errors that result directly from incorrect, incomplete, unclear, or misleading information supplied by the customer.
Once production has begun, changes to customised or personalised products may not be possible.
Customised and personalised products are generally not eligible for cancellation, return, or exchange except where required by applicable law or where the product supplied is damaged, incorrect, defective, or materially different from the confirmed order.
CUSTOMER-PROVIDED ARTWORK AND MATERIALS
Where you provide us with photographs, logos, trademarks, text, illustrations, artwork, designs, names, or other content for customisation, you confirm that you own that material or have the necessary rights, licences, permissions, and consents to provide and use it.
You are responsible for ensuring that customer-provided material does not infringe any copyright, trademark, privacy, publicity, personality, contractual, or other rights of any third party.
We reserve the right to refuse any customisation request that we reasonably believe may be unlawful, infringing, offensive, misleading, harmful, or otherwise inappropriate.
To the extent permitted by law, you agree to be responsible for claims arising directly from material supplied by you where you did not have the necessary rights or permissions to use that material.
PRODUCT AVAILABILITY
Products may be available in limited quantities and may be modified, discontinued, temporarily unavailable, or removed from sale without prior notice.
We reserve the right to limit purchase quantities, restrict the sale of certain products, or decline an order where reasonably necessary.
Acceptance of payment does not guarantee fulfilment where an item becomes unavailable, is affected by a technical error, or cannot reasonably be produced or supplied.
If we are unable to fulfil a prepaid order, we will contact the customer and provide an appropriate resolution, which may include a refund for the affected item or order.
PRICES
Prices displayed on the website are subject to change without prior notice.
The price generally applicable to an order is the price displayed when the order is successfully placed, subject to correction of genuine errors in pricing, discounts, promotions, taxes, shipping charges, or technical calculations.
We reserve the right to correct any obvious or genuine pricing error.
If an error materially affects an order that has already been placed, we may contact the customer before fulfilment and provide the option to proceed at the corrected price or cancel the affected item or order.
PROMOTIONS, DISCOUNTS AND OFFERS
Promotional offers, discount codes, bundle offers, coupons, free gifts, and other promotions may be subject to separate eligibility requirements, validity periods, product restrictions, minimum purchase values, maximum discounts, or other conditions.
Unless expressly stated otherwise, promotions cannot be combined.
We reserve the right to withdraw, modify, limit, or cancel promotions where reasonably necessary, including in cases of misuse, technical error, suspected fraud, or unintended application of a discount.
ORDERS
Placing an order constitutes an offer to purchase products from us.
We reserve the right to accept, decline, hold, or cancel an order where reasonably necessary.
This may include circumstances involving:
- Payment failure or suspected fraud
- Incorrect pricing or technical errors
- Product unavailability
- Incorrect or incomplete customer information
- Duplicate orders
- Misuse of promotional offers
- Repeated refusal of COD deliveries
- Suspicious or unusually high-volume purchases
- Unauthorised resale or commercial activity
- Orders we are unable to fulfil
- If we cancel a prepaid order before fulfilment, any amount eligible for refund will be processed through the applicable payment method or another mutually agreed method.
CUSTOMER INFORMATION
You agree to provide accurate, complete, and current information when placing an order or interacting with our services.
You are responsible for ensuring that your name, phone number, email address, billing information, shipping address, pin code, customisation details, and other order information are correct.
We are not responsible for delays, failed deliveries, additional shipping charges, losses, or incorrect fulfilment resulting from inaccurate, incomplete, or outdated information provided by the customer.
SHIPPING AND DELIVERY
Shipping charges, dispatch estimates, shipping methods, and delivery options are displayed on the website or at checkout.
Any dispatch or delivery timelines stated on the website are estimates unless expressly stated otherwise.
Delivery may be affected by courier operations, serviceability, weather, public holidays, logistical disruptions, remote locations, government restrictions, force majeure events, or other circumstances beyond our reasonable control.
A delay in delivery alone does not automatically entitle the customer to cancel a made-to-order or customised product once production or fulfilment has commenced, except where required by applicable law.
Customers are responsible for ensuring that someone is available to receive the shipment at the delivery address provided.
PRIORITY SHIPPING
Where Priority Shipping is offered, it refers to priority processing and/or dispatch according to the timeline stated at checkout or on the relevant product page.
Priority Shipping does not guarantee delivery by a particular date unless expressly confirmed by us in writing.
Final transit and delivery timelines remain dependent on the courier provider, destination, serviceability, and circumstances beyond our reasonable control.
CASH ON DELIVERY
Cash on Delivery is available only for eligible orders, products, values, and delivery locations.
Additional COD charges may apply as displayed at checkout.
COD may not be available for customised or personalised products or for orders exceeding the applicable order-value limit.
We reserve the right to disable or refuse COD where reasonably necessary, including in cases of repeated refusal of deliveries, suspicious orders, fraudulent activity, incomplete customer information, or logistics limitations.
FAILED OR REFUSED DELIVERIES
Where delivery fails because the customer is unavailable, refuses the shipment without a valid reason, provides incorrect information, or does not respond to courier communication, additional shipping or re-dispatch charges may apply.
For COD orders, repeated refusal or non-acceptance of deliveries may result in COD being disabled for future orders.
For prepaid made-to-order or customised products, refusal of delivery does not automatically create a right to cancellation or refund.
PAYMENTS
Payments may be processed through third-party payment gateways and financial service providers.
We do not directly store complete credit card or debit card information on our systems.
Payment processing is subject to the terms, security standards, policies, and systems of the applicable payment provider.
We are not responsible for payment failures, banking delays, authorisation failures, or transaction issues caused solely by third-party financial institutions or payment processors.
Where a payment is debited but an order is not successfully confirmed, resolution may depend on reconciliation with the relevant payment provider or bank.
TAXES AND CHARGES
Applicable taxes, shipping charges, COD fees, Priority Shipping charges, or other fees may be displayed separately or included in the total order value, depending on the transaction.
Customers are responsible for any additional charges imposed by authorities or service providers where legally applicable and not already included in the amount collected by us.
RETURNS, REPLACEMENTS AND CREDIT NOTES
Returns, replacements, damaged-product claims, incorrect-item claims, missing-item claims, credit notes, and related resolutions are governed by our Shipping & Returns Policy.
Customers must comply with the timelines, evidence requirements, and claim procedures stated in that policy.
Nothing in these Terms is intended to restrict or exclude any right or remedy that cannot lawfully be excluded under applicable law.
DAMAGED OR INCORRECT PRODUCTS
If a product arrives damaged, incorrect, or incomplete, the customer must report the issue within the timeline stated in our Shipping & Returns Policy and provide the information or evidence reasonably required to verify the claim.
We reserve the right to inspect and assess the claim before approving a replacement, return, refund, or credit note.
A claim may be declined where there is insufficient evidence to establish the issue, where damage arose after delivery, where the product was misused or altered, or where the issue falls outside the scope of the applicable policy, subject always to rights available under applicable law.
CUSTOMER COMMUNICATIONS
By placing an order, submitting an enquiry, requesting support, or otherwise engaging with us, you acknowledge that we may contact you through email, telephone, SMS, WhatsApp, or other appropriate communication channels in connection with your order, payment, delivery, customisation, enquiry, customer support, or other requested service.
We may send promotional or marketing communications where permitted and where applicable consent has been obtained.
You may opt out of promotional communications using an available unsubscribe method or by contacting us.
Transactional, service-related, security, and order-related communications may continue where necessary.
INTELLECTUAL PROPERTY
All artwork, illustrations, product designs, sculptures, maps, graphics, photographs, videos, visual compositions, layouts, concepts, branding, logos, trademarks, text, packaging designs, product names, website content, and other original materials created or owned by Colour Taxi or Tohfa Shofa are protected by applicable intellectual property laws.
Unless expressly agreed otherwise in writing, purchase of a Tohfa Shofa product grants ownership of the physical product only.
It does not transfer copyright, design rights, trademark rights, reproduction rights, commercial-use rights, digital rights, or any other intellectual property rights in the underlying artwork or design.
You may not copy, reproduce, manufacture, adapt, modify, trace, scan, digitise, distribute, publish, sell, license, commercially exploit, or create derivative products based on our designs or artwork without our prior written permission.
TRADEMARKS
Tohfa Shofa® and associated names, logos, branding, graphics, and marks are trademarks or proprietary identifiers of Colour Taxi.
Nothing on this website grants any licence or permission to use such trademarks without prior written authorisation.

All website content is provided for the purpose of presenting and selling our products and services.
You may view the website for personal, non-commercial use.
No website content may be copied, extracted, republished, redistributed, commercially exploited, scraped, used to train or populate commercial databases, or otherwise reused without our written permission, except where such restriction is prohibited by law.
CUSTOMER REVIEWS, FEEDBACK AND SUBMISSIONS
You may provide us with reviews, feedback, photographs, testimonials, suggestions, comments, or other materials.
You confirm that anything you submit is lawful and that you have the right to provide it.
Where we wish to use customer-provided photographs, testimonials, or identifiable content for marketing or promotional purposes, we may seek or rely on applicable permission or consent as required.
We do not claim ownership of customer intellectual property merely because it has been provided to us for fulfilment of an order.
THIRD-PARTY SERVICES
We may use third-party providers to support our website and business, including ecommerce platforms, payment processors, logistics companies, shipping providers, hosting providers, analytics services, communication platforms, advertising providers, and other technology services.
Third-party providers operate under their own terms, policies, and systems.
To the extent permitted by law, we are not responsible for failures or losses arising solely from the independent acts or omissions of third-party providers outside our reasonable control.
THIRD-PARTY LINKS
Our website may contain links to websites, applications, or services operated by third parties.
We do not control those third-party services and are not responsible for their content, availability, security, accuracy, terms, or privacy practices.
Access to third-party services is at the user’s discretion.

Our collection, use, processing, storage, and disclosure of personal information is governed by our Privacy Policy.
By using our services, you acknowledge that personal information may be processed as described in that policy.

The website may occasionally contain typographical errors, inaccurate information, outdated information, or omissions relating to product descriptions, pricing, availability, promotions, shipping charges, timelines, or other information.
We reserve the right to correct genuine errors, update information, or make necessary changes.
Where a material error affects an order already placed, we may contact the customer before proceeding.

However, except for rights, guarantees, or warranties that cannot lawfully be excluded, the website and related online services are provided on an “as available” basis.

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Colour Taxi, Tohfa Shofa, their proprietor, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of the website, inability to access the website, or circumstances beyond our reasonable control.

Where such circumstances affect an order, we will make reasonable efforts to communicate with the customer and provide an appropriate resolution.
FRAUD AND MISUSE
We reserve the right to review, hold, cancel, or investigate transactions where fraudulent, suspicious, abusive, or unlawful activity is reasonably suspected.
We may request additional information reasonably necessary to verify an order or transaction.
Where necessary and permitted by law, relevant information may be shared with payment providers, logistics companies, financial institutions, law-enforcement authorities, or other appropriate parties for fraud prevention or investigation.
SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the maximum extent permitted by law.
If necessary, the affected provision will be severed without affecting the validity or enforceability of the remaining Terms.
NO WAIVER
Failure by us to exercise or enforce any right or provision of these Terms on any occasion does not constitute a waiver of that right or provision.
TERMINATION
These Terms remain effective while you use our website or services.
We may restrict or terminate access where we reasonably believe a customer or user has materially violated these Terms, engaged in unlawful or fraudulent activity, abused our systems, or created a security or operational risk.
Rights and obligations arising before termination will continue where appropriate.

These Terms, together with our Privacy Policy, Shipping & Returns Policy, and any other policies expressly incorporated by reference, constitute the agreement governing your use of the website and our services.
If there is a conflict between these Terms and a product-specific or transaction-specific term expressly agreed with you in writing, the more specific agreed term will apply to that transaction to the extent of the conflict.

We may revise these Terms from time to time to reflect changes in our business, products, services, technology, policies, or legal requirements.
Updated Terms will become effective when published on the website unless a later effective date is stated.
Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
